I think we've all lived in small apartments where something a neighbor does trespasses on our privacy. Feel for both sides on this one.

Easy way to make a buck... the floor trading business is way down with the rapid success and expansion of online order systems... maybe they're having a hard time paying for that "high end East 79th" place.

I agree that we all know of some neighbor that impacts another person's living quarters...

I would as well Cigg. Considering the guy has tried to remedy the situation with multiple fixes and most of his cigar breaks are outside. I would file this one under frivolous with out a doubt. I would also pray and hope the other Tennant's wife burns something in the kitchen. I would then file a counter suit and say I no longer feel safe in my adjoining apartment due to the stress caused by the smoke alarms and the smell of burned food.:stickbeat

The air quality can easily be monitored to see if there's any merit to this which I doubt. I get these types of "sick building" complaints all of the time at work where office workers complain about headaches and nausea until we have the rooms, buildings, and systems tested. Not once in over 20 years and at least 2 dozen complaints has the air quality tested bad, in fact it always tests better than the outside air!

I sometimes fill for my neighbors when I'm on the porch smoking. Even though we were neighbors for over ten years, and we speak and have cordial conversations I do believe behind closed doors they are cursing me out! LoL I can hear them now " I wish he would smoke those stinky A$$ cigars someplace else....blah..blah....blah!" Duh well....:cbig:

Id counter sue for the the nieghbors kids playing to loud. The noise is tresspassing into my apartment through the walls. And the smell of the dirty diapers is so pungent that I cant eat my dinner. Flip the script see what happens lol

Speaking of 2nd hand smoke. You know what does piss me off when jack-asses bring their children into smoke filled cigar shops. That's the only time you'll ever hear be complain about 2nd hand smoke. It's selfish and the kids can't choose whether or not to be there. As far as the apartment scenario if he doesn't live in a smoke free building what. I don't think he can do much.
