Sorry for the noob question.

Why can Cigar companies outside of Cuba use brand names such as Cohiba, Montecristo, Hoyo d m, Punch, etc?

It seems like it should be trade name infringement to me? :dunno:

Due to the embargo the US has with Cuba, the Cuban brands are not officially recognized in the US so they can get away with it. The US is the only country that does this, so it is not an "outside of Cuba" thing. In some countries that sell Cubans and non-Cubans the American brand with the same name is sold under another name.

That is really messed up in my opinion.

I guess there is a lot of money in play if they steal the names just for the US market.

I'm taking a Global Marketing course right now, and there is an interesting case in which a Chinese company has trademarked the name "iPad" in China. The Chinese government is preventing Apple from selling iPad's in China because the other company owns the naming rights.

People in the class had mentioned this could never happen in America. I mentioned "not so fast", and explained the whole cigar naming rights, and how many of these cigar consortium's have ripped off Cuban names. The other students are left scratching their heads in disbelief.
