ATLANTA (AP) — The Georgia Supreme Court has turned down an appeal from a teen who was sentenced to 10 years in prison for having sex with a 15-year-old.
In a ruling released Friday, the court denied a motion for reconsideration filed by lawyers for Genarlow Wilson, who was 17 when he and the 15-year-old engaged in consensual oral sex. He was sentenced for aggravated child molestation.
Wilson’s case was one of two cases that were cited earlier this year when lawmakers passed a law that otherwise strengthened penalties for sex offenders, but reduced the penalty from a felony to a misdemeanor for some teenagers convicted of sodomy.
Presiding Justice Carol Hunstein noted that in easing the penalties for teens, ‘‘the Legislature expressly chose not to allow the provisions of the new amendments to affect persons convicted under the previous version of the statute.’’
Hunstein added she was ‘‘very sympathetic to Wilson’s argument regarding the injustice of sentencing this promising young man with good grades and no criminal history to 10 years in prison without parole and a lifetime registration as a sexual offender because he engaged in consensual oral sex with a 15-year-old victim only two years his junior,’’ but said the court was bound the by limits set by the Legislature.

I think that is a huge load of crap. He had no record and good grade and was acting just like the rest of us did when we were 17. If they found every 17 kid out ther who had gotten a hummer from a 15 year old girl, we would all be in jail. In CA sex under the age of 18 is illeagal, no matter if consensual or not. Is is titled Unlawful Sex and is punishable by jail for both parties.

There is a little more to the story than just "Teen in jail for BJ."

Four years ago, Wilson and five other males decide to party with two teenage girls, one 15 and one 17, in a hotel room on New Year's Eve. They all have sex with both girls. Next day, the 17 year old says that it wasn't consensual, but rather she was raped. The police investigate and search the room and find a videotape of the "party."

All of the men are charged and the others, knowing they might face a mandatory 10 year sentence with no parole, plea bargain. This gets them misdeanor convictions, small jail sentences and no "sex offender" status.

Wilson on the other hand, decides to fight the charges and goes in front of a jury...dumb. He's convicted and now now is stuck with a felony sex offender conviction. Oddly enough, he was acquitted of the rape of the 17 year old. After two years of the ten year sentence, the media starts the campaign to get him released, (since he's such a good boy) which results in a wave of publicity and today's Supreme Court Ruling. It was turned into a racial issue here in Georgia, with black congressman citing it as an example of "over-prosecution" of young black males. The DA is also black, but that didn't seem to matter.

A bizarre case all the way around, but the facts were cherry-picked by the national media and spun so that Wilson appeared to be a victim.
