murder or self defence?

Definitely not self defense since he was never in any danger. If they came in his house then that'd be a different story. I hate anyone that robs, but it seems like he wanted to kill them. Why walk outside and give preemptive words like that then? :dunno:

When I was 17, I went into a neighbor's garage and stole a cheap (uninstalled) $25 car radio. It was stupid and mean, but I don't think it justified their next door neighbor shooting me to death on the way out. We all do stupid things. I grew up to be a pretty good guy. A beating would be justified. :)

It's just a situation I would struggle with. If it was my house, then hell yea I'd defend it. If it was my neighbors house, then I'd call 911 and hope they had good home insurance.

About 10 years or so ago my uncle was awoken by somebody tring to force a window open to his house. He called the police and got his gun out and held the robber at gun point until the police showed up. It turned out this guy was sober and lost. His sister lived down on the next road and he just hitched hiked about 1000 miles to visit her. His sister new he was comming so he just thought she forgot to unlock the door. He was lucky my uncle was going to shoot then call the police.

I heard about this since I live in houston. At first I didn't think too much of it as a homicide and was leaning more on the side of the shooter, but once I heard the 911 call I'm not so sure. Then again, this guy has been working with the police, but you just got to wonder why he couldn't have just held them at gun point till the cops got there instead.

I think he may have reacted a little fast but I can't say that I wouldn't have step out and tried to stop them myself. Especially with them on my property. That may be the factor that keeps him from serving time. That and the fact that I don't think there is any jury in Texas that will convict him.

my reply might seem harsh, but form what i had heard about the case, it seemed that the robbers did not stay still. They might have approached him.

And they may have been running away...who knows. He did fire three shots though, and after the first, do you think they would still be coming at him? We'll see if they have shotgun pellets in their backs.

However, here in Maryland (tough handgun laws), a man who owns a jewelry store in downtown Bethesda was robbed and he chased the the guy down the street with a loaded .38 and blew the dude away in broad daylight ,in the middle of a crowded street.

He walked.

So, in the end, was it justified homicide? Depends who you ask I guess, but a jury in Maryland did not convict him and I doubt a jury in Texas will convict this guy.

Glad I am not sitting on his jury.

Seems like he committed a homicide. Was it justified? Did the suspects have motive, opportunity and was the man's life in jeporady? All three must occur to be justified.

Trust me on this boys, there ain't a TV made worth taking someones life for.
There's not one possession in my home that's worth anothers life, that's what insurance is for.
That being said, if I feel myself or my loved ones are threatened, I will remove that threat, no warning, no hesitation, just dead.

No matter what the legal system comes up with on this one, it seems to me he's already paying a price that will only get heavier over time.
