I'll be interesting to see if there are any repercussions to this gouging.

I'd leave them out of the party for a year if they sold over msrp+tax, but I'm a spiteful bastard.

I think the CRA distribution idea would take care of alot of this. It might even save people some money on taxes. If the "wholesale" cost to the shops is $0, they shouldn't have to pay any tobacco taxes, right? haha It could really even the playing field as far as price goes.

I know he does. I just spoke to a close friend of his and he is going to do something different next year. From what I understand he has said what he is going to do and it was one of the ideas presented here on BOTL.

I cannot say what it was since like anything thing it could change and it is Pete's prerogative to state his intentions. But what I heard, i liked...

From what I understand, Pete really feels bad that all this is going on as his goal is to get his sticks into the hands of us the consumers, that is where his heart and his intentions are. No matter how the execution is screwed up by the retailers, Pete really does have our best interests in mind.......

Just got a call from Empire Cigar, they are doing some packages;

Option A- 1 Frank, 1 Drac, 2 Boris, 2 El Triunfadore $95.06

Option B- 4 Dracs, 4 Boris, 2 El Triunfadore, 2 Tainos $166.97

What about shipping? I believe the SCHIpp tax is paid for by the manufacturers. THE MSRP tax takes into account the price, which includes mandated tobacco taxes, again California having the one of the highest taxes in the US. Retailers in California are selling the cigars for $13. The cost of cigars that the retailers pay in regards to what they charge is profit. Based on the prices, it doesn't appear kosher to me, but what do I know. Nothing!

MSRP stated by manufacturer does not take into account any state tobacco tax incurred by the retailer.

$13 msrp is $16 retail in NY with the 46% tobacco tax on the wholesale value of cigars.

NC tobacco tax is 13% though. California's is 45.3%. It used to be 47.5% lol. The Schipp tax is still paid for by the manufacturer though, not the retailer. Some manufacturers have raised their MSRP to encompass the Schipp tax.

Sort of doesn't matter though. It all boils down to what someone is willing to pay! Spend your money as you would like to. Don't if you don't want to.

In defense of the one retailer, I understand and I have never had any dealings that the customer service is excellent, the packaging is great and the communications from start to finish are outstanding.

SCHIP should NOT be added to these, as Pete is paying that himself. The cost should be retail ONLY plus shipping for out-of-staters, and retail plus NC taxes for in-staters.

September 1, 2009 - Starting today September 1st the tax on a pack of cigarettes will increase 10 cents to 45 cents a pack. The tax rate for other tobacco products will be increased to 12.8% (from 10%) of the cost price (means the actual gross purchase price of the other tobacco products before any discounts, rebates, or allowances and before the excise tax is applied) of the product.

Every person subject to the excise tax on other tobacco products under G.S. 105-113.35 are required to pay an additional tax equal to the difference between the previous tax rate and the new tax rate on all other tobacco products held in inventory on the effective date of the tax increase. The additional tax is equal to the difference between the former tax rate of 10% of the cost price of other tobacco products and the increased tax rate of 12.8% (2.8% is the difference between the previous rate of 10% and the new rate 12.8%). The inventory and the additional tax are due to the Department of Revenue 20 days after the effective date of the increase. (Important Notice Regarding Other Tobacco Products Excise Tax Rate Increase and Tax on Inventory on Effective Date of Increase, North Carolina Department of Revenue, 8/2009)

With NC Cigar Tax at 12.8 of wholesale and sales tax at ~8 the prices on that bundle aren't bad.

I wouldn't have figured NC to be a relatively high tax state for tobacco.
