I am the custodial parent of my three girls, been this way since 2006. I have always had insurance on them as mandated by the courts, I work for a health insurer. Mom (NCP) never has as she should (mandated by the courts). She is now trying to get the girls covered under Medicaid under her income. Is this possible? She (mom) insist that she can get the covered under her income and the time they are with her. Something sounds fishy to me, as the girls have insurance and coverage through me. Why would Medicaid cover them when they have insurance? Mom insist she can and that she can get them contacts and braces through Medicaid.

Anyone with knowledge and not hearsay on such issues? I am in TX btw.

I call bullshit B! The question is you as the custodial parent, do you want her to do this? If she can w/o you giving up any rights, is it a bad thing? Braces and contacts if needed and if you insurance won't cover this sounds good for the kids, no?

Brian I am going through custody issues also and I was under the impression that the non-custodial parent is required to provide health insurance. Maybe the mother is trying to abide by the courts order? :dunno:

That is correct. She just never has. I have paid for their insurance, their copays, the glasses, etc. She has never reimbursed me half, though I have given her receipts. That is a whole other legal issue.

In answering the other question posed, she it would be good it they could get those things (glasses, contacts, braces) and me/us not have to foot the bill outside of insurance. My question is, is it legal? She has in the past tried to circumvent the law.

Yep, that is the question. If it is legal, fine. It just seems a little squirrely to me? I'm wondering if she is trying to claim that she is the CP, so you can qualify for food stamps and other government and state programs.

Brian read through the order from the court. It should state that the non-custodial parent is required to provide medical. She may just be doing this to cover her butt so that you can not take her to court for not following the order.

Yes, that is what the order states, pretty generic, I have medical, she have medical, we spilt cost, copays, etc. I just think she is trying to find a way to get coverage as it will not cost her anything.

I am an attorney (Arizona), but the best advise I could give even someone here would be to call your attorney. This doesn't appear to be something worth guessing about.

I've had similar problems with my sons mother. Let's just go in together and split the cost on a hit man and get our problems solved once in for all. It always seemed like a good option to me.
