Here's one from my backyrad... A hospital in metro Atlanta has adopted a hiring policy to not employ anyone that smokes. Heated debate on this one, of course. Seems things like this have coined a new term... "Lifestyle Discrimination".

GWINNETT COUNTY, GA -- Gwinnett Medical Center is in the business of good health. And that's why they will no longer hire anybody who smokes.

"As a healthcare provider, we feel it's important that we practice what we preach," said Steve Nadeau, the hospital's human resources executive. By promoting its brand, the hospital is also protecting its patients from other health issues like second-hand smoke. But the decision has lit a fire under the long smoldering controversy on smokers' rights.

"It's a little bit of a stretch for an employer to dig that far into your personal life," said Eston Hood, as he puffed a cigar with friends. "Generally when you start talking about employment, you're talking about coming to work, being able to perform at a high level."

At the Highland Cigar Company in Atlanta's Inman Park, the debate filled the air as thick as the smoke itself. "I don't think it's fair," said Robert Lockett. "It has some discriminatory ramifications when you talk about prohibiting someone from earning an income and providing for their family because of a personal habit that's non-detrimental to them doing their job." Many at this tony neighborhood smoking den questioned what other indulgences might fall like the dominoes they play here if companies have the right to police your lifestyle. "You might as well deny people employment because they eat too much fatty food, because they drink too much caffeine," added Arthur Withers.

Across town at Piedmont Park even the health conscious questioned the benefit of the employment ban.

"If they're not [smoking] in front of people or even patients, I don't think that should be a basis of hiring or firing," said jogger Megan Herak. Jason Weidart agreed. "If they're doing it at their house I don't see a problem with it. But definitely I think smoking should not be around the hospital any way shape or form."

Labor attorney Catherine Banich says the hospital's rule is not illegal. At least not in Georgia. The ACLU refers to such employment rules as "lifestyle discrimination." And thousands of companies across the country practice it.

Critics say the real question is where does it end?

They add that simple choices such asdriving to work, jogging, bike riding, and sun-bathing can be dangerous. So should people who do those things be banned from working as well?

This is nothing new. In California I know of a few law enforcement agencies that allow no tobacco use on or off duty. No cigars, no cigarettes, no dip(chewing tobacco), nothing.

It's one thing to not allow them to smoke at work, and I can understand that, but if they are going to take that kind of a stance then they shouldn't hire people who drink alcohol, overeat, or have sex without condoms too. Stupid...

Jeez... When will it stop. :frownno:

Kinda like not hiring someone for their credit score. I know some good guys who are good hard workers who've lost cars, houses, etc.. Doesn't mean your a bad worker, sometimes just some bad luck, or just a bad $$$ manager.

Someone needs to start handing out bitch slaps soon...

yep and this is where they have begun sliding down the slope. Lets see how the fat people handle it when they say sorry we won't hire you because you eat too much. That would be a lawsuit for sure.

As long as a person's performance is not affected at work, then there should be no issues. It does not seem right that they are going that deep into a person's personal life

friend of mine who is a firefighter cant smoke on duty anymore either...if you are a newbie getting hired, you cannot smoke at all...even outside of work. the older guys that have been there for longer than ten years are allowed to still smoke off the job...stupid indeed.

Don't think its not happening already. Your credit score is fast becoming your lifestyle and who you are,,,either responsible or not when it comes to getting insurance. If your credit score suck you will probably be paying more for your car or home owners insurance. When I was working there are certain "indicators" that will tell an employer about how one manages their finances and if there was an area of concern our employer would not hire them. Health issues are more than fair game when it comes to hiring...companies are not going to continue to pay the high medical benefits if they know that a future applicant is sufferring from some auto immune illness or is prone to heart conditions, diabetes and other ailments.

Maybe we need to get it classified as a disability... :)

This whole "on or off duty" thing has been creeping up for some time now. Part of the reason I refuse to take a job that requires a drug test.

Nothing new, indeed. Hospitals here in the KC area have had similar policies. My hospital is not as strict, but there is absolutely no tobacco use on the grounds of the hospital.

I'm not sure about the "practice what you preach" comment from the Human Resource representative. The hospital doesn't necessarily preach that tobacco is bad. Sure - everyone knows a lifetime of smoking cigarettes will likely result in emphysema and probably cancer, but using premium cigars on an occasional basis does not make for bad health!!!

When I'm asked for my medical opinion on the subject, I always compare my use of cigars to that of alcohol. Too much alcohol is bad for your body. Cirrhosis of the liver is a common endpoint and will likely contribute to your death (if an alcohol-related accident doesn't do it first). Too much tobacco can also be a problem - but it doesn't mean it's bad if one uses it in moderation.

Anyways - my two cents from my physician anti-bacterial soap box!
