Im just chiming in to say this because I really feel this way.

What does America even stand for anymore? Sure isnt about freedom from persecution nor liberty and justice for all.

So sad to go from being the best country in the world to circling the toilet. End rant

Clayton's ban on smoking in parks and other outdoor places is under fire. A lawsuit has been filed against Clayton officials by a man claiming the ban tramples on his rights.

One of retired Clayton resident Arthur Gallagher's favorite activities is to relax in the park with a cup of coffee and a cigar. With the recent outdoor smoking ban, a cigar in the park would cost gallagher a one-thousand dollar fine or 90 days in jail.

So Gallagher has decided to challenge the ban, announcing a lawsuit against the city, Clayton Mayor Linda Goldstein, park officials and Clayton police.

With cigars in hand during the news conference, Gallagher and his attorney Bevis Schock explained that the ban is an infringement of constitutional rights

They are disputing the city's claim that second hand smoke is harmful to others even outdoors in a park with children present. But Arthur thinks the ban goes even further than trying to protect people.

Clayton Mayor Linda Goldstein released a statement regarding this case saying the city heard testimony from several other communities that banned smoking in public outdoor parks.It also says more than 478 communities have banned smoking in public parks across the United States.

Whatever happened to the "pursuit of happiness"?

In my eyes we are getting closer and closer to a comunist country. People can't even "just say no". If you don't like strip clubs, don't go. If you don't like smoke in a bar, find another one that doesn't have smoking.

How can we say that you can't smoke in a public place when the carcinogyns (spelling) in that air far outway the output of a cigar. Plus, what about the person over the boarder who's smoke is blowing accross the line? Should we go after them?

Just thought this country would have gotten better in time, not worse.

At least some of us got to live in a time where "The People" made the decisions. And they were rational decisions.

Good on him for taking a stand against the smoking ban! These laws have been taken too far for far too long! I understand giving non-smokers the right to not have to breath foul air all the time, but there has to be a balance - and right now, the pendulum has swung in favor of the 'non-smoking-nazis'!

I would have this mans attorney look into if they're are any public grilsl being used there and sue the city for endangering his health.

I hope the CRA would get behind this guy. If he wins this could set precedence for the rest of the nations' public parks. I don't have to worry about this as of now because our lawmakers in Louisiana have knocked down stuff like this. We are still allowed to smoke in bars, tobacco shops and anywhere else where the food sales does not count for more than 50% of their sales.

They just passed a law like this in NYC. No smoking in parks, beaches, or the new "pedestrian plaza" areas in the city. Around here they're citing secondhand smoke and cigarette litter as the justifications.

There needs to be more suits so that the anti smoking lobbyists know that we're willing to fight. As it stand for the last couple of year the anti smoking people pretty much walk all over us...we hardly put up a decent whimper.

If we don't stand up to these little smoking bans popping up all over the country pretty soon we're looking at 1984.
