Isn't this stuff just the best... They are going to completely ruin a legal industry. People will still get their smokes by other methods, then poof they won't have any tax revenue whatssoever for the states as far as sin tax and wonder where it all went...

I HATE Washington State with such a passion. The more you learn about our politics the more you want to move away. Christine Gregoire can go to hell, and I mean that in the most hateful way possible. I have no respect, nor will I ever have any respect, for that awful of a person who also cheated her way into office.

Bummer for that guy. The state is goin gto put him out of business. He'll file bankruptcy to eliminate the debt, and the state will still not get what it is seeking.

Maybe he was just cheating on his taxes.....just saying

besides the fact the cigar taxes suck, i don't have sympathy for the guy. His whole basis of his appeal is that the tax forms weren't clear about out of state sales? Who cares. Read the statutes and know what you're getting into before you start a business. You don't like it, then pick a different state to run the business out of...

This is an example of a state government that has spent too much. Instead of cutting back, they continue to tax more. I hate living here as well....

Seems pretty cut and dry to me, he should have paid the OTP tax.
Chip tax is already applied so charging a tax on top of that seems like double taxing in my opinion and gives other state government the right to follow suit. This is how many of the buisnesses we rely on provide there sevices and help keep the overtaxation of tobacco products at bay. Infact most buisness's eat the tax just to stay in buisness.

Chip or schip which I think you mean, has nothing to do with state, city or local taxes. From a brief read through the WA Dept of Revenue website, everybody must pay a tax on tobacco that is brought into the state of WA, same as here in NV and most other states. Here in NV if they that tobacco is then sold out of state or used for the wholesalers personal use, no OTP tax is required, however it is still documented on the forms that get filed with the state. Without knowing the full details behind this story, I would wager that this guy did not do his paperwork correctly and show the tobacco coming into WA and then going out, or WA still charges the OTP tax whether it stays in the state or goes out of state.

SCHIP is nothing but another way for Washington to steal our money. I abhor any kind of cigar tax, but the guy in the article is an idiot.

What did he expect to happen?

As much as I don't like it, I agree with Vegan here. When you run a business, you can't claim ignorance and try to get away with it.

With that said, I think the politicians in WA are stupid... would they want to earn revenue on moderate taxing of a cigar business that takes in $750,000 a year, or would they want to earn a very high tax on a business that shuts down taking in $0? Change the laws, keep businesses in business and earn some tax revenue.
