Gotta love how this tiny little snippet completely fails to relate the most important part of the story...you know, the part where the off-duty school safety agent grabbed the gun from the wounded officer so as to continue to fend off the armed robbers that had shot the police officer. It also fails to note that they were actually CONSIDERING bringing the guy up on charges because he wasn't licensed to carry a gun.

Firstly that's not relevant to the original posted story in any way. Secondly you do realize the state government is in Albany around 300 miles north of NYC which your posted story takes place in.

You also should realize the gun control laws in NYC (which are the laws your story are based on) are completely different than the rest of the state especially upstate where Albany laws rule.

Shit like this makes me (almost) embarassed to be an American.

And to think that just a few hundred years ago babies were born on dirty cave floors (and still are)...how did our species ever make it this far without an over reaching government watching out for us.

Your link confuses me. In the story you posted the man who shot the robbers will NOT face charges. Do you think he should?

My guess is that you think it was ridiculous that he MAY have been charged. Hopefully, a police officer on the forum will chime in, but, legally speaking there off course could have been a chance he was going to be charged since (1) he did not have a license to carry a gun; and (2) he was not defending his property, but that of another citizens. All that being said, they DA made the right choice in my opinion not to charge him, but the vast majority of states have gun laws that would at least leave the door open to charge him if there was more to the story.

1) He wasn't carrying a weapon, he was using it. The Police officer who had been shot had been carrying. Carrying ceases to be "carrying" once the weapon is drawn.

2) He wasn't protecting property, he was protecting his life and the life of a police officer.

The only reason the short little story I posted even exists is because it got out that they were thinking of charging this individual and a massive uproar ensued. You post as if the possibility of this individual being charged with a crime is only logical given the circumstances. I'm sorry, but I categorically reject that premise.

Well, we agree that the thought of him being charged is ridiculous - no matter the law. The unfortunate part of it, is that I would bet that at least part of the decision not to charge him was because of the uproar that would result, and the possibility of citizens demanding that the gun laws be changed, something that Albany surely does not want to happen.

We had a simular story in Baltimore about a year and a half ago, however, the facts were a bit drastic as a Johns Hopkins student cornered a burglar in a garage and delivered a death blow to his chest with a samurai sword after taking his hand off.

Seriously though I'm very disappointed in the lack of common sensibility these days. But if you're a politician and you're not passing laws on something, people might begin to think you're not needed I guess :dunno:..
