Hey man, that really sux, but I'm glad to hear that you're not hurt. You'll know this morning about how sore you're going to be.

Who is the other driver's insurance carrier? Were you carrying collision coverage on your vehicle? If he's insured they'll only be paying you the actual cash value of the vehicle...check online with Kelly Blue Book and use the "Private Party" listing to get an idea about what you might be offered.

I understand the advice about obtaining a lawyer right away, but I'd hold off until you know whether or not you'll actually need one...you don't want to give away 1/3 of any potential settlement to an attorney if you don't have to.

Keep us updated.

I missed this thread before. I'm sorry this happened to you, and I thank God it wasn't worse. He must have plans for you.

I'm glad the other guy is alright too. Yeah, he did a stupid thing and nearly got you both killed, but we are human and we make mistakes. Hopefully he learned from this one.

Yeah, I am glad the coffee is ok, too, but only for your sake.

Glad to hear you are doing well, but I have a couple of questions for you.

What does the other vehicle look like? And is the coffee ok?

:)

The other driver's vehicle is most likely totaled as well. It's really surprising that neither of us was hurt in the least.
I called his insurance company yesterday to get the claim rolling and played phone tag with their adjustor today.
I was a little achy this morning, but not bad. My neck is a little sore on the right side (opposite of the side that was hit). Again, not bad at all.
Since the truck is so old and I haven't driven it much lately I only had liability and uninsured motorists coverage on it. His insurer is called Safeco, which I've never heard of. Someone told me it's a company that covers "hard to cover" people who've had problems with insurance before (tickets, accidents, DUI's, etc) but I don't know for sure.
I'll wait and see what the adjustor comes up with. It can't be all that much for a vehicle as with as high a mileage and as old as mine was so there'll be no new truck in my future. Maybe just another older one. An old truck has advantages. You don't worry so much about hauling stuff around and scratching it, sliding off the road in the winter and things like that. The bummer is I don't know if I'll be able to find a used truck that was as reliable as mine was. That thing was great!
As has been said, it could have been worse. A fraction of a second difference in timing and I might not have been able to be typing this right now. In light of that I'd say things have worked out well so far and will go fine from here on out. Any day above ground is a good day!

Safeco is actually a pretty good company, although there are good and bad adjusters with every company...sometimes it's just a crap shoot with what adjuster gets assigned to your claim. I think that Safeway is the non-standard company that your friend was probably thinking about.

Hopefully they'll treat you right!
