It's tough to pass any judgements on either of the parties... I really feel this is going to be a 3-sided story, and may neither one be completely in the right or wrong.

These lawsuits always start out as misunderstandings then escalate into lawsuits. This will probably get settled just cause the way cigar market isn't exactly booming and nobody wants to leave money on the table. As with all litigation both sides are right and both sides are wrong just hope they can settle this cordially.

FYI,

I haven't used any AGANORSA leaf since late 2006.

So this will not change anything in it's current state.

I think Fernandez is being a sensitive bitch because he was not asked to be part of My Father Cigars. Tough s**t! That is business. Fernandez just had the raw materials, Garcia had knowledge and skill. If anything, Fernandez underestimated Garcia's entrepreneurial savvy.

If anyone would like more information on this case, I've downloaded the plaintiff's complaint and the defendant's answer to the complaint through PACER (electronic court records database). Other than that, it looks like they've been butting heads in the discovery phase for the last 6 months.

Who cares, really? Does this affect you? There's nothing positive to take away from this thread between the assumptions and false information. There's a reason why this is decided in the courts and not on the internet.
