So for those that dont know we put our house on sale last month, iit sold in 2 days. As part of the deal the buyers cannot buy our house untill we buy a house. Well, after ours sold we found a house, put a bid in and it was accepted. While doing a title sweep, a lien on the land was found. Our mortgage company(nor any other) will give us a loan till its cleared up. Its been almost 6 weeks now since this was found, we have been in contact with the sellers to try to fix this as they cannot sell the house with this lien to ANYONE, so we asked them if they would rent to us while they fix this. We thought they agreed, as of lastnight they are know acknowledging us and are not trying to fix the lein. So come Monday we may not have a place for Myself, my wife our 2 daughter, 2 dogs, the cat and my reef tank. Yaye. On top of it, my allergies are threw the roof, my asthma is crazy and I have not been able to smoke much. Sorry for the long post, but im pissed.

Sorry to hear about this.. I hate it when people refuse to pull their weight for whatever reason if I was in your place I'd send a legal notice there way and ask for damages.

So, is your contingency clause not in effect? Seems like you're in your house until you sell. You might lose the current buyers, but you won't be out of a home.

You might try to negotiate down on the purchase price or include an addendum to the contract to include the lien being cleared at time of funding. You'd have to get the mortgage company, the sellers and the lien holders to agree. Real estate laws vary greatly from state to state; I'm not sure what is applicable in Jersey.

The property touches water(a river). The state is "claiming" 16ft, need to clear it up for us or anyone to buy the house.

My wife is a realtor and my mother is a broker, it's in good hands, but the buyers need to work with us and they are just keeping us in the blue. It just wearing both me and my wife down...

Can't you get an apartment in the mean time. I know we have ones here you can rent for a month to like 4 months.

Yeah, we're going to have no choice. Just not sure if we can find one that will take 2 dogs, a cat and a 55g fish tank. Looks like my reefing hobby will come to an end...

Sorry to hear, I'm sure it's a big stress! But look on the bright side, you sold your house when many people are having problems. Sure it might be a rough couple months, but I bet things will work out just great in the long run.

That's rough man, I hope everything works out. I know some apartment complexes allow large water tanks but you might need to let someone hold onto your pets for awhile.

D: Id love nothing more than to sew the pants off these 2 dbags. Unfortunately there has been no contract. Which brings to bear the newest news: They still dont "get it" and they had the balls to ask why they dont have our deposit for the rental!!!!! WE DONT EVEN HAVE A CONTRACT FOR A RENTAL!!!!! They wont rent it unless we have a buyers agreement, we cant buy anything till they get this title fixed. AHHHHH!!!!!

So it seems the sellers contacted another lawyer, one that deals with these types of situations. So know it seems they get it, they put a significant amount of cash in escrow. As our attorneys were hammering out a deal in which we can rent from them while they fix this, it came up that the original survey in which the land in question was 10% of the property it now seems is more like 30%, in which theres a concrete pad built on the land. So my attorney advised us not to close with the money in escrow bc there may be a chance that its going to cost ALOT more than what they put in. I dont know, Im at a loss, Im physically and mentally drained. We still have to pack our house up hire movers etc etc etc..., and we still dont have a place to live. Thanks for lettin me vent here guys, and thank you all for the support. Im a firm believer in things hapen for a reason, so only time will tell with this one.

Well, they rented it to us. So me and my family have at the very least a roof over our head till they A: get the title fixed or B: not get the title fixed and we have to find another place to live.

What a weight that has been lifted of my shoulders. Now the fun art of moving, I hate moving.
