Being sued for $4 mil

This stems from a car accident that my wife was involved in last year. An older couple (the driver was in his mid 80's) ran a red light and totaled both my wife's car and their own. Ours was a newer model and protected my wife fairly well (she had a couple minor injuries). The other people did not fair as well, but their injuries were not extreme / life threatening. There was only one eye witnesses (who didn't see the whole thing) and the police made no real determination as to who was at fault.

Now we find we are being sued by the couple for $2 mil each. My auto liability insurance is about 1/15th of that figure. Our ins. co. has a lawyer on retainer already and my wife will need to go in for depositions, etc.

This has definitely been an interesting year (to forget).
Both my wife and I have been unemployed for most of the year and now this ... :wtf:

It's only 9:45am, but I need a stiff drink.

Isn't that the purpose of your insurance? To cover for what they can get, as stated they can request whatever they want. I was hit a few years back, it did 8k on my car, 4k in medical bills and I got $1200.00. My lawter said next time have someone hit you with a name across the side of their truck, UPS, FEDEX, etc... They have larger liability, thus larger pool to draw from.

Don't worry about it, this type of thong happens all the time. You are lucky that the officer did not find you at fault, because no one was deemed at fault file a counter claim for mental dis-stress in the amount of $4million.

I was sued for $1 million a few years back. I didn't have to do a thing. My insurance company took care of everything. The other person got paid the maximum my policy offered ($15K).

Worst part was my insurance was dropped after that and my premiums went up.

They will never collect. Unless you have a huge amount of assets lying around the majority of us are pretty judgement proof. Even if they win, your state should have protections for your home (assuming you own it) as well as quie a bit for "personal items". I am sure the insurance company will reach a settlement. Worse case scenario if they win you file for bankruptcy protection and they get nothing.

that sucks big time, hate that people use lawsuits to solve there problems. You should counter-sue for emotional distress which effected both you job performance causing the loss of your jobs, claim 6million and hope they drop theres

Hang in there man!

My brother got sued by some people for a car accident after they railed into him! The one lady was wearing a neck brace for court too! They didn't get anything because they had a history of filing frivolous lawsuits.

Counter-suit is an option too - this can be a tool to use in reducing or getting them to drop there suit depending on how things turn out. As always, consult your lawyer(s) before taking action though.

Sorry to hear that Ted but like Bill basically said you can sue for anything, getting it is a whole different story. Besides they're probably just trying to get as much as they can out of your ins. co. in a settlement. It just sucks that you have to go through the BS.
I'm sure everything will work out fine.
