I don't understand that either. If someone runs a red light and causes an accident. They should be 100% at fault. I hope that was documented in the police report? Or the eye witness can account to it. If anything, it sounds like you should be should be taking them to court. As they are the ones that wrecked your car.

I had a similiar lawsuit once, a no fault accident and I get sued for 1.5mil, I countersued for 5mil the suit was dropped. I iwas out a $500 lawyer bill.

I also had a nieghbor sue us after her daughter broke her arm on our swingset. They told us "we're not suing you just your insurance company". If not for my lovely wife stopping me I'd have punched my first woman, right in the mouth, in fact thinking about it now I still want too. Sadly my they still live in the neighborhood and my daughter still plays with their girls. The husband won't come within 100ft of me but that mouthy bitch comes over to get hers girls and tries to be friendly, C*NT.

Hang in there Brother! They dont have a big case against you, besides, what do they need with 4 million bucks if they are about to kick the bucket! :angerFU:

W O W. I would have had a chat with her about her daughter no longer being allowed on my property, and if she herself steps onto it, you'd have her charged with trespassing. Simply wow.

Hope everything turns out okay for you guys...hopefully the worst of it will just be having to go in for the depos.

If they are really hurt that badly then they have to sue you and collect the limits from your policy before they can tap into the underinsured coverage that their own insurance policy provides.

That being said, it's probably not a good idea to be discussing the pending litigation on an open board like this, as it is discoverable. Just sayin'...

first off, i apologize to any fine brothers on here who are attorneys. but WTF! when we were kids, we played at each others houses and if we fell or got hurt, or even broke an arm, you went to the dr and got it fixed and were told to be more careful. now it's all about finding fault so someone pays. and who always gets their cut??????????

Sorry to hear, something like this happened to my folks whan I was a teen and caused an accident. The people who sued got less than the insurance max and less than the offered settlement. Then they sued their laywers for screwing it up. I know how stressfull it is, but sometime it's just a bluff and dosn't pan out for the....

How yours goes away without to much pain.

My wife says we all have to live here just try to get along and for her (and my daughters) I'm civil, well I have not punched her thats civil isn't it?

With the amount of broken bones I've had I sould be rich or at least made an attorney rich. My insurance company won't tell me if they settled the case either, wtf?

Based on that info, I'd say the POLICE were at fault!
I hardly blame the police. They were not on scene at the time, and as there were no witnesses that saw everything (at least none that stopped and offered to get involved) ... it basically comes down to a he said / she said case.

I know the most likely outcome is that our insurance company will settle with these people, it will be a hassle as my wife may need to miss time from work for depositions and other attorney meetings. Plus our rates will likely rise, etc.

I asked about a counter-suit, but our attorney said that as our real damages were only about $1500, it doesn't make much sense since this would involve bringing in an additional lawyer on their side. Best just to keep the odds at 1:1.

Sorry to hear you going thru this but like most are saying on here,,,let your insurance handle it as it looks like this becomes a case where they are looking to collect something. The cops did not determine it was your fault so you can breath a huge sigh of relief and you could actually keep this suit going until they pass away,,theoretically.

Take that stiff drink and then move forward in finding a job and living your life. Don't let these old cooters rob you of one day.

That's frickin sick. Does the guy not realize he ran a red light? There should be no way to prove it was your fault, but since civil trials are are a TOTAL joke in favor of the lawyers, if I were you I'd get some personal legal council on fortifying your assets now--just in case. There is a lot you can do to protect yourself I you act ahead of time.

They are just trying to get a settlement out of it. Its up to your insurance to decide if they want to fight it or not.
I'm pretty sure your insurance company will want to fight this to the bitter end. This is proof of how corrupt this country is and continues to be. I don't blame the old people at all...I blame the spineless attorney for charging them up to believe they have a slim chance of receiving two million dollars per person. He's only looking after his on financial gain. I'm pretty sure he encouraged them to ask for everything including the kitchen sink. With any luck they'll kick the bucket before this even makes it to court.

On a side note, I hope and pray that things turn around for you and your wife. I empathize with the BOTH of you. Last year was the worst year of my life. Went through a bitter divorce and been unemployed (just to name a few) since October 2008. I can honestly say from personal experience that God will not put more on you than you can handle. So, keep your head up and trust in God that things will turn around soon. God Bless you and your family.
